Conditions of use for the use of www.guterstart.nrw. de in the context of the input of local offers (as of 02 / 2024) - based on the terms of use of the country NRW:
Preamble
The Ministry of Children, Youth, Family, Equality, Escape and Integration of the Land of North Rhine-Westphalia - MKJFGFI, hereinafter referred to as "the Provider," operates the web-based application "Good Start NRW."
The application offers, in the sense of a technical infrastructure, the possibility of using a web-based database for all municipalities in NRW with its own public institution for youth assistance (Youth Office). The database can be filled with family-relevant offers. Each youth service has access to the system's backend.
By using the system, local authorities provide children, young people and families, but also professionals working with the target groups with free information about offers and facilities. The system thus meets the requirements set out in Section 2 of the Law on Cooperation and Information in the Protection of Children (KKG) and pursues the objective of the country programme "child-strong - NRW creates opportunities" to provide families with low-level access to information, advice and support services.
The search function is available free of charge to every citizen ("user") without prior registration on the Internet, provided that the relevant community wants to use the offer for itself and refers to the link. The use of the search page is voluntary for the municipalities.
These terms of use regulate the contractual relationship between the depositing body and the provider and the municipalities, represented by the regional competent youth offices, hereinafter referred to as "the municipality." These are the youth offices, but also others, such as other offices or providers of offers.
1. Subject matter
1.1 The online system Good Start NRW is a web-based database that the provider offers to all municipalities with its own public youth aid for free use.
1.2 The system allows the local authorities to enter offers for families, children and young people into a database to make these users accessible within.
1.3 To set up a search portal with the web-based application, the youth offices can log in and enter local offers. A separate search page can be designed for each youth department, using which all local offers entered for the respective district are available on a website. This search page is stored as a link in the online system Good Start NRW and can be linked without much effort.
1.4 With the registration in the system the following terms of use for the use of the online system Good Start NRW are accepted.
1.5 The municipality undertakes to inform the provider of the use of the web-based application when publishing the data. It is sufficient to send a mail to the mailbox guterstart @ mkjfgfi. nrw. de to be sent.
2. Rights and obligations of the provider
2.1 The provider is responsible for providing the application
and shall endeavour to ensure proper operation of the application. It does not guarantee the uninterrupted usability or Accessibility of the service, still liable for technical transmission delays or failures. For example, there may be a temporary interruption of the services due to technical disturbances or necessary maintenance.
2.2 The provider provides free support.
2.3 The provider is not responsible for the data used by the local authorities or other authorities. It does not guarantee the topicality, accuracy or completeness of the information provided or linked.
2.4 Liability claims against the provider relating to direct or indirect damage of a material or ideal nature caused by the use or non-use of the information provided or linked are in principle excluded.
2.5 The use does not create any rights or obligations between the provider and the user or the user of the online offers.
3. Initial registration in the database
3.1 All municipalities with an independent public youth aid (Youth Office) have access rights to the system.
3.2 The municipalities ensure that all the data it provides for registration are true and complete.
3.3 Access, such as to providers or youth aid planning, is a priority.
3.4 The application is used to conclude an unpaid contract for the use of the services of Good Start NRW between the State of NRW and the municipality.
3.5 In the first registration, the municipality uses the initial password it received from the provider when registering. It is obliged to keep the password secret. The municipality can change the password independently. The provider will not ask the municipality for the password at any time.
3.6 The initial users have all the roles and rights in the system.
3.7 The provider does not guarantee the actual identity of a depositing body and the actual right to set content.
3.8 The provider shall ensure that new initial users can be created if necessary.
4. Registration of other filing bodies
4.1 The municipality may grant further access rights to, for example, providers of offers, other offices (hereinafter referred to as "other depositing bodies") used to fill the database by third parties. The other depositing body is obliged to report a change in the user data of the municipality without delay.
4.2 The other depositing bodies ensure that all the data it provides for registration are true and complete.
4.3 The municipality can control the action options of the other depositing bodies in the system by providing roles in the system.
4.4 After a registration, other depositing bodies will receive a password from the municipality for registration. The password can then be changed from the other place.
4.5 The password must be kept secret.
4.6 The municipality may check the plausibility of the data used by the depositing body and the completeness of the information to be provided with regard to the necessary information (e.g. address, e-mail, telephone number). The accuracy of the information provided shall not be verified. The municipality does not guarantee this.
4.7 If the Commune is aware of the incorrect content or of any infringement of the information provided by the notifying body, it shall delete the relevant information.
5. Obligations of the depositing body
The local authorities themselves, as well as other depositing bodies, have access rights.
The depositing body shall:
5.1 to set all content and photos published on the website in accordance with the German copyright and service protection law. Any exploitation not authorised by the German copyright and service law shall require the prior written consent of the provider or the respective rights holder. The content and rights of third parties shall be identified as such.
5.2 to include only true and non-misleading information in the profile of the local offer. This is particularly true for contact information and contact persons.
5.3 to ensure that the necessary consent is available for the publication of personal data within the meaning of the basic data protection Regulation (GDPR). This also applies to photos where people are clearly shown. Providers and Commune shall not be liable for lack of consent in the setting of personal data by the depositing body.
5.4 to regularly review the timeliness of the data provided.
5.5 to refrain from any action likely to affect the functionality of the online system Good Start NRW.
6. Change of services on the website www.guterstart.nrw. de
The provider reserves the right to change or offer different services on the website www.guterstart.nrw.de. The service may be discontinued by the provider only with a period of one year to 31.12. the following year, in order to open up the possibility of a replacement to the municipalities and the depositing bodies. The recruitment of the service must be explained to all the useful municipalities.
7. Termination of cooperation between the municipality and other depositing body
7.1 The other depositing body may terminate the cooperation at any time without giving any reasons. The termination shall be indicated to the youth office of the respective community which has established the access. Access to the editable area is then blocked, and content editing is no longer possible.
7.2 The municipality may at any time, for important reasons, end the cooperation with the issuing body. In this case, access to the editable pages is blocked. In particular, important reasons may be: non-compliance with legal provisions by the depositing body, the depositing body's failure to comply with due diligence in the registration of the content, significant impairment of the reputation of the system offered by the depositing body, damage to one or more other persons by the depositing body.
8. Responsibility for content, data and / or information of users
8.1 The provider is not responsible for the data used by the local authorities or other authorities.
8.2 The provider does not guarantee the topicality, accuracy or completeness of the information provided or linked. All offers are subject to change and without obligation.
8.3 If external links are stored in the database by depositing bodies and / or local authorities, they are not under the control of the provider and they are not responsible for the content and security of external websites.
8.4 Local authorities do not take responsibility for the content, data and / or information provided by the online-system Good Start NRW and for content on linked external websites. External links are subject to the liability of the respective depositing bodies. The depositing body shall, in the first connection of an external link, check the foreign content for any legal violations. Providers and communities have no influence on the current and future design and the content of the linked pages. In particular, the provider and the community do not ensure that the content of the external links is true, can fulfil a specific purpose or can serve such a purpose. The setting of links does not mean that the provider or the municipality will own the pages behind the reference or link. A constant control of the external links is not reasonable for the provider and the municipality without specific indications of legal violations. However, if there are any legal violations, such external links will be deleted immediately.
8.5 The provider and the municipality do not assume any liability for the accuracy, completeness and timeliness of the content provided by third parties. However, local authorities are responsible for the content they have incorporated into the system. The applicant shall be responsible for the accuracy, completeness and timeliness of the content provided. Additional information on the individual local offers gives the opinion of the depositing body and not necessarily the opinion of the provider or the municipality.
9. Liability of the provider
The provider is not liable for the accuracy of the data set. Liability claims against the provider relating to direct or indirect damage of a material or ideal nature caused by the use or non-use of the information provided or linked are in principle excluded. Claims for body damage and for material damage under the Product Liability Act remain unaffected.
